To preface this: I sent this to Sato in a PM and he liked the idea. He asked me to post this in a thread so everyone could discuss it.
Okay, so here's what we know about the Mangekyo Sharingan and the Eternal Mangekyo Sharingan respectivly.
What we know about the initial activation of the Mangekyo Sharingan: It's activated the same way as the Sharingan, by great grief or sadness. Typically, this is triggered by the loss of a loved one, though this doesn't always have to be the case, nor do you have to kill them (as shown by when Obito unlocked MS when he saw Rin die). You also, on the sites rules, have to have 3 Tomoe to unlock MS.
What we know about MS: We know that as the user continues to use the Mangekyo Sharingan, the eye begins to deteriorate. The user begins to feel pain as their powers grow, eventually causing them to go blind.
We know that when Sasuke fought Kakashi shortly after killing Danzo, he used his Susano'o and had a pain in his head. His Sharingan deactivated and his vision was shown to be nearly gone.
We know that when Itachi fought Sasuke, his vision was also nearly gone, as shown by several "First person" point of views from Itachi's perspective.
Now, we know that when a Mangekyo Sharingan is
TRANSPLANTED into another person who also had Mangekyo Sharingan, their eyes "attain new light that never fades." Now we know that a transplant is the removal of an old, damaged organ and replacing it with a new one. This is NOT a fusion of the two pairs of eyes. My theory is that this happens because the new chakra of the new owners reinvigorates the eyes, bringing them back to "full health" as it were, and preventing them from deteriorating again.
Now, to counter EMS and all the worries about it, our limit for Uchiha is five. And EMS is not any more powerful than MS. It only prevents fading. It does not eliminate the pain a user feels when using MS techniques, nor does it reduce chakra cost or anything like that. And once more, we know that you need the eyes of a close blood relative (sibling/parent) in order to attain EMS. So, if your character does not have a sibling or a parent they can get MS eyes from, you have no way of obtaining EMS.
This means, at most, due to the limit, only four characters could run around with EMS at any given time. One would be stuck with regular MS until another was killed and a relative was made.
You also have to remember: The chances of even living long enough to obtain EMS is low. The Uchiha are constantly hunted for their eyes, and by the time you've gotten MS, you wouldn't be a Genin anymore, most likely.
Personally, I feel that if you live long enough for you and a sibling to obtain MS legitimatly, you should be allowed to trade your eyes. To make up for gaining such power though, there should be a "healing" period after the surgery, maybe 2-3 days OOC, where your character can't see and is vulnerable to enemy attack, due to the eyes still adjusting to the body. Though, you could have an NPC or PC guard, if you have friends in your village.
